Terms of use
These terms govern your use of Kids Writing (the “Service”), an online English writing practice product operated by Ariven (“Ariven”, “we”, “us”). The Service is designed for Australian learners roughly aged 7–12 and their parents or guardians. By creating an account or using the Service, you agree to these terms.
1. The Service
Kids Writing provides educational writing activities, guided coaching (including features that use artificial intelligence), gamification such as rewards and progress views, and related tools described on our website at kidswriting.com.au. We may add, change, or retire features to improve learning outcomes, safety, or reliability. The Service is intended as a supplement to school and home learning — not a replacement for classroom instruction or formal assessment.
2. Who may use the Service
The Service is built around a single learner profile per account. The person who registers the account must be an adult with authority to agree to these terms on behalf of the household (for example, a parent or guardian). You confirm that any child using the Service under your account does so with your permission and supervision appropriate to their age.
You must provide accurate registration information and keep it up to date. You are responsible for all activity that occurs under your account, including activity by anyone you allow to use your credentials.
3. Acceptable use
You agree not to:
- use the Service in any way that is unlawful, harmful, harassing, or intended to interfere with other users or our systems;
- attempt to probe, scan, or test the vulnerability of the Service, or bypass security or access controls;
- copy, scrape, resell, or publicly redistribute content from the Service except as allowed by law or with our written consent;
- use automated tools to bulk-generate requests or content in a way that degrades the Service for others;
- misrepresent your identity, affiliation, or age.
We may investigate suspected misuse and may suspend or terminate access if we reasonably believe these terms have been broken or if continued use would pose a risk to users or the Service.
4. AI-assisted features
Some parts of the Service use AI to suggest prompts, coaching, or feedback. AI outputs can be incorrect, incomplete, or unsuitable for a particular context. They are learning aids only: students should think critically, follow their teacher's instructions for school work, and not rely on AI output as a sole source of truth. You remain responsible for how suggested content is used (including checking facts where relevant).
5. Accounts, security, and availability
You are responsible for safeguarding your login details and for any devices used to access the Service. Notify us promptly at support@kidswriting.com.au if you suspect unauthorised access.
We aim for reliable availability but do not guarantee uninterrupted access. Maintenance, third-party providers, or events beyond our reasonable control may cause downtime or degraded performance.
6. Fees and trials
We may offer free trials or paid plans. Where fees apply, they will be presented before you commit. Unless stated otherwise at purchase, recurring subscriptions renew according to the billing terms shown at checkout. You are responsible for any taxes that apply to your purchase.
7. Intellectual property
The Service, including software, branding, text, graphics, and documentation, is owned by Ariven or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your household's educational purposes in line with these terms.
You keep ownership of original writing and content you create in the Service. By using the Service, you give us the limited rights we need to operate and improve the product (for example, hosting, displaying, and processing your content to provide feedback), as further described in our Privacy policy.
8. Privacy
Our collection and use of personal information is explained in our Privacy policy. Please read it alongside these terms.
9. Disclaimers
The Service is provided for general educational practice. We do not warrant that use of the Service will achieve any particular academic result, test score, or outcome. To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other laws that cannot lawfully be excluded, restricted, or modified.
10. Limitation of liability
Subject to the previous section and to the extent permitted by law, we are not liable for indirect or consequential loss (such as loss of profits, data, or opportunity) arising from your use of or inability to use the Service. Where our liability cannot be excluded, to the extent permitted by law it is limited to resupplying the Service or paying the cost of resupply, or (if you paid fees for the period in question) to the fees you paid to us for that period.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or close accounts that breach these terms, pose a security risk, or where we are required to do so by law. Provisions that reasonably should survive (including intellectual property, disclaimers, and liability limits) continue after termination.
12. Changes
We may update these terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, by email or an in-product notice). Continuing to use the Service after the effective date means you accept the updated terms.
13. Governing law
These terms are governed by the laws of Australia. You and Ariven submit to the non-exclusive jurisdiction of the courts of Australia.
